The service allows you to preview and download via your Short Message Service ("SMS") mono ringtones, poly ringtones, operator logos, caller group icons, picture messages, screen savers, SMS games and text based services such as horoscope, jokes, quotes and directory listings ("Item(s)") on to your download-compatible mobile phone at the price specified by SOHOmobile to you ("Service") from time to time. You are responsible for all charges incurred if you accidentally erase, replace or delete one of the Items by receiving another Item or otherwise. Ringaroo Mobile is a subscription service. Join any Ringaroo Mobile download services , each subscribed service entitles you to 4 free truetone download per week and costs just $4.00 per week until you send md stop to the shortcode advertised herein. First time user would be charged based on single download rate of the requested items, followed by the applicable subscription rates for the subsequent weeks. Single download rates are as of follows: $4.00 per weekly hot content list subscription renewal; $2.00 per 2 Mono Ringtones, Picture Messages, wallpapers; $4.00 per Poly Ringtone; $4.00 per MMS Content including but not limited to Animations; $6.00 per Games; or otherwise cheaper during promotional or seasonal period. The content owners reserve full rights on changing the pricing without prior notice. Please ensure that your handset is WAP /GPRS enabled before you initiate any download. Due to some phone screen sizes and resolutions, images downloaded may differ slightly from that shown. You must have sufficient credits to receive your orders. SOHOmobile currently provides users with access to a rich collection of resources, including mobile content, mobile news and mobile information and entertainment services (the "Service"). You also understand and agree that the Service may include advertisements and that these advertisements are necessary for SOHOmobile to provide the Service. You also understand and agree that the Service may include certain communications from SOHOmobile, such as service announcements, administrative messages, the SMS membership fee, and that these communications are considered part of the membership and you will not be able to opt out of receiving them unless you terminate your account. Any new features that augment or enhance the current Service, shall be subject to the TOS. You understand and agree that the Service is provided "AS-IS" and that SOHOmobile assumes no responsibility for the timeliness, deletion, mis-delivery or failure to store any user communications or personalization settings. You are responsible for obtaining access to the Service and that access may involve third party fees (such as Internet service provider or airtime charges). You are responsible for those fees, including those fees associated with the display or delivery of advertisements. In addition, you must provide and are responsible for all equipment necessary to access the Service.

Please be aware that SOHOmobile has created certain areas on the Service that contain adult or mature content. You must be at least 18 years of age to access and view such areas.


Costs for SMS Request for download of Item
Please be informed that you will be charged the standard charges per SMS request for download of Item onto your mobile phone. For downloads of mono or poly ringtones, graphics and texts, there will be an additional charge upon delivery of the same item. Please check against the specific download item price here. If the mobile phone does not belong to you or if someone else is paying the mobile phone bill please obtain that person's consent prior to using the same.


Equipment
You will need to provide all mobile phone equipment required to use the Service and you will be liable to pay SOHOmobile for all costs incurred using the Service.

You will need to provide all equipment necessary to access the Website, its content and the Service on the World Wide Web and be liable for payment for the telephone call charges at the rates published by the telephone operator with whom you make your calls.

This Service is only available to Telstra, Optus and Vodafone post paid mobile and prepaid mobile services users respectively. By using the Service you confirm that you understand that your mobile phone must support the Item download function for the Service to operate. For the purpose of downloading ringtones, your mobile phone must support the respective ringtone format standard. If you are unsure whether your mobile phone supports the ringtone format standard, please consult your mobile phone handbook or call 1300665873 (Monday-Friday, 10am-5pm). SOHOmobile cannot be held responsible should you attempt to download an Item onto an incompatible phone and you will be charged regardless.

Your Registration Obligations
In consideration of your use of the Service, you represent that you are of legal age to form a binding contract and are not a person barred from receiving services under the laws of Australia or other applicable jurisdiction. You also agree to: (a) provide true, accurate, current and complete information about yourself as prompted by the Service's registration form (such information being the "Registration Data") and (b) maintain and promptly update the Registration Data to keep it true, accurate, current and complete. If you provide any information that is untrue, inaccurate, not current or incomplete, or SOHOmobile has reasonable grounds to suspect that such information is untrue, inaccurate, not current or incomplete, SOHOmobile has the right to suspend or terminate your account and refuse any and all current or future use of the Service (or any portion thereof) and you agree to forfeit all credits accrued under the service. SOHOmobile is concerned about the safety and privacy of all its users, particularly children. Please remember that the Service is designed to appeal to a broad audience. Delivery of Service
After receiving your download request via SMS, SOHOmobile will send the Item to the given telephone number. If your download request via SMS is insufficient or incorrect or if SOHOmobile for any other reason considers it necessary, SOHOmobile has the right to decline to send the Item without further notice to you. SOHOmobile shall not be liable in any way for failures, defects or delays in the delivery of the Item, which are caused by one or more of the following reasons:

your phone does not support the specific item format: Nokia Smart Messaging Standard (NOK), EMS iMelody (iMelody), Motorola Ringtones SMS (MRS) and Ericsson Melody (eMelody) service (for download of ringtones), your phone does not support SMS, your phone is out of range or for some other reason cannot be reached, or some other failure which is not due to SOHOmobile occurs in communication or otherwise.


Termination and Suspension
SOHOmobile reserves the right to cancel, withdraw, terminate or suspend the Website, its content and the Service for any reason whatsoever at its sole discretion without notice to you. You agree that SOHOmobile shall not be liable to you or to any other party for such cancellation, withdrawal, termination or suspension.
